As a respondent if a claimants representative is making a personal injury claim against me could this be considered a conflict of interests? After dismissing an employee this woman acted as a companion at appeal, claiming to be a Union official. She resisted showing her accreditation saying we were frustrating the data protection act in asking but finally produced certificates and a Unison card. The respresentative who is clearly no stranger to suing people is also threatening to sue myself and her former employers becuase I have made a complaint about her recording phone conversations and meetings without my knowledge or consent and for her threatening behaviour and use of scare tactics. Her employers agreed and she no longer works for them. However, in her latest letter threatening to sue me for defamation of character by producing "privelged" documents at the hearing she has said her union will sue me but on contacting them they have no knowledge of this even though she claims to have a response from their solicitors. The union say as I own a coffee shop she could not have acted as a union official in this sector and would have had to inform me she was acting as a lay official, which she didn’t. She was also advising the employee as an employment law specialist for the Citizens Advice Bureau. She had a fall on leaving the shop after the appeal in which she told the paramedics she had been suffering from a bad leg all day and it gave way but later put in a claim to say she had tripped leaving the premises which our insurance is dealing with. Along with a threatening letter she has now advised us she has agreed to represent the employee at trial. This woman is out of control and has lied constantly. Could I write to the judge prior to the hearing to ask that he review her involvement? Should I use conflict of interest only or should I send her threatening letter along with the response from her union also? She is trying to get us to leave out vital evidence by threatening legal action and she addressed this to me personally rather than the company? Please help?! What do I write to the judge?
Thank you laughter for your answer. Would I have a reason to ask for a motion to dismiss her as a represetnative? I am unsure how I need to word it in order to ask that her ivolvement be reviewed? Would I just ask that the case in general be reviewed? Thank you for your help.
Also, we have evidence that the claimant is being untrue on her schedule of loss, apart from the fact we offered to discuss giving her job back and she refused and there need not have been a loss, she is unwilling to voluntarily provide any evidence of mitigating her loss, her representative claims it’s an invasion of privacy! However, we know she can’t provide evidence because it will show she hasn’t told the truth. Can I write to the tribunal to ask them to order her to provide evidence? I can’t even make an offer as her rep has told ACAS she isn’t willing to accept less than the schedule of loss at this time! The hearing is less than a month away.

I am a stay at home mom who also does daycare for a few friends of ours. The daycare kids come at 7:00, in which he is supposed to be up and ready to bring them to the bus stop. He and I have not slept together in years, he sleeps downstairs by the kids and I sleep upstairs (split level house). So, he falls asleep on the couch and if one of the kids comes out of their room they crawl into bed with him. So, when his alarm goes off in the AM, they wake up.

Now, only one of the kids goes to school, so it is pointless for the other two to be woken up. In fact, due to their lack of sleep they are literal monsters in the morning!

I have tried getting him up, and he won’t wake up no matter what I do.

This summer the kids got up at their leisure. My point of view is that kids need sleep BUT not an alarm to wake them up!
Ummmm….how in the world did it turn into a question of me getting more sleep? There is a very unfair judgement by one of the answerers to this question and that is that she is assuming that I am mad because he is waking me up. I’m already up, honey. I prepare breakfast for my daughter in the morning before she leaves. I am only upset because I feel as though my kids are not getting the benefits of sleeping in. That is part of the reason I stay at home with them!

i have a 98 pathfinder my key has suddenly wont come out of the ignition but car still will turn on and off. problem is i know that to stop my alarm going off i always shut the door and open it with the key but obviously i cant do that. is there a way to stop my alarm from going off and to allow me to start the car again.

please don’t give me a hard time. im going to be a teen mom. my baby is due any day now and im kinda scared. i found on some web sites that that baby will come right after the water breaks. on other i have found something else. i was also wondering about the pushing part of the birth. if the baby is starting to come out on my way to place where i am going to do i push it out or not. i have heard that childbirth hurts like hell and im really scared about it i have had two false alarms and it scares me. my boyfriends (he is not the father the father died from cancer) dad is a doctor and we were going to do a home birth. so what do i do if the baby is coming out when im in the car please for the love god help thank you guys sooo much…. if you have any advice please give it too me so i know what do to do during the labor and the birth.

i work in the mall in NC and my employer, also the owner of the store, watches us through the cameras that are in the store from his house. he apparently can pull them up on the internet or something and watch us live?? he will sometimes call the store and ask questions like "why has this person been in the back for so long?" or "i see yall haven’t been busy since you’re just standing around behind the counter". i find this very creepy and strange and kind of an invasion of my personal space.

is this legal?? if not, what are the reason behind this? if somebody feels the need to waste their time watching their employees during the day, why don’t they just go to the store and work themselves?

Anyone know why this is happening and what I need to do to correct it?

My van won’t start after trying to replace the stereo. I think I may have triggered the alarm system and now the van won’t start. Anyone have any suggestions on how to get it running again?

I moved to a new address in Dec 2008 and updated my contact and billing details shortly after on my account on the company’s web site. I continue to pay by direct debit even though I have never received any Itemised bills by the post. In October 2009, my account was suspended. When I called to find out why, I was told the new occupant of my former address had called the company to report I no longer lived there and asked for no further mailings to be sent. So even though I had changed my address online, for some reason the company took no notice of this. They realised they were at fault, they apologised and as a good will gesture took £5 off my next bill. I thought this was over. The problem is, I still haven’t received any bills since then. I logged into my account online and the billing address still remains. And even worse it’s just a summary not itemised. I called the company and they confirmed they have still been sending my bills to my former address. For over a year I’ve been paying by direct debit without knowing the details of what I’m paying for. Do I have a case here? Can I sue for distress under the Data Protection Act? Does anyone know any no-win-no-fee solicitors who handle such cases? Thanks.

One of my internal hard disk went out. They were set up in RAID 0 and lost all data. Got a new hard drive and re-installed Windows XP. Had to start from "scratch" as I could run the Acronis Recovery for some reason.
